\n\t\t\t\t\t\t\t\t\tI have noted with great interest a release by the Department of Information purportedly \ncoming from the Maritime Administration (MARAD) in relation to the Guyana \nregistered vessel EOLIKA, which was detained by Senegalese authorities after three \ncontainers of ammunition valued at USD 5.2 million were discovered on board in the \nPort of Dakar in January 2022.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tVessel tracking information indicates that the EOLIKA was en route to Port Georgetown \nand was due to arrive here on January 28, 2022 at 1200 hrs.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tAccording to the release, the vessel\u2019s registration expired on 10th December 2021. The \nrelease further expressed MARAD\u2019s belief that the registration documents might have \nbeen issued by the International Maritime Safety Agency of Guyana (IMSAG). The \nrelease concludes by stating that MARAD severed ties with IMSAG since August 13, \n2021.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tThe following facts are important to note.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tRegulations titled The Guyana Shipping (Registration of Ships) Regulations set out the \nframework for the registration of ships in Guyana.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tRegulation 17 addresses the scenario where a ship becomes entitled to be registered and \nit is not in its home country. That regulation provides that if a Guyanese ship is at sea or \na foreign port when it becomes entitled or due to be registered, a proper officer (that is, \nan officer authorized to perform the registration function) may issue a provisional \ncertificate. Regulation 17 goes on to provide that the provisional Certificate of \nRegistration gives the ship registered status until it arrives at a Guyana Port or after the \nexpiration of 6 months, whichever first happens.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tSuch regulations are common throughout the world, and its intent is to simply make \nsure that vessels traversing the high seas are registered to a particular State. The \nnationality of vessels provides an important basis for maintaining order on the high \nseas.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tIt is therefore disrespectful to the people of Guyana for the government to issue a release \nwhich suggests that the expiration of EOLIKA\u2019s registration one month ago, somehow \nabsolves the Administration and renders the vessel of no concern to Guyana.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tThe regime then purports to accuse IMSAG of issuing registration documents, but notes \nthat it had severed all ties with the organization since August 2021.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tOn February 12, 2021, the Director General of MARAD, signed a letter of authorization \ndelegating MARAD\u2019s authority to IMSAG. The Authorization requires a minimum notice \nperiod of twelve (12) months by either party for withdrawal of the authorization.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tOn May 28, 2021, the Director General of MARAD via letter informed the Secretary \nGeneral of the International Telecommunication Union (ITU)\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tOn the November 11, 2021, IMSAG sent out correspondence to \u201cAll the Port State \nControls and Relevant Authorities\u201d with the subject \u201cRepresentation Administration of \nInternational Ship Registry of Guyana by IMSAG\u201d in which IMSAG confirmed its \nrepresentation of Guyana.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tIf one were to give MARAD the benefit of the doubt, that there was a severance of the \nagreement on August 10, 2021, in keeping with the terms of the agreement that \nseverance would only be effective from August 9, 2022.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tThe Government of Guyana is lying to the people of Guyana.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

The PPP\/C Administration must therefore at once make public:<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t1. The correspondence terminating the agreement with IMSAG and notification of the \nrelevant international agencies of same.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t2. The registration information of all vessels flying the Guyana flag under this so-called \nGuyana International Ship Registry being administered by IMSAG.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tThe implications of this situation are dire. How can Guyanese be sure that there is not currently in existence an international network of vessels flying under the Guyana flag \ninvolved in all manner and sorts of nefarious activities?\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\tThe PPP\/C administration continues to demonstrate their incompetence to conduct our \nforeign affairs, maintain law and order and meet the obligation of international treaties \nto which we are party.
